1. Overview of the Service

PODStoreFront is a no-code ecommerce and print-on-demand platform that allows businesses to build online storefronts, personalize products through a live product customizer, manage orders, and connect to third-party payment, shipping, and print fulfillment providers. PODStoreFront is a division of LP Cloud Lab and operates the Platform on behalf of Merchants who register for an account.

2. Eligibility and Account Registration

2.1 You must be at least 18 years old and capable of forming a legally binding contract to create an account.

2.2 You agree to provide accurate, current, and complete information during registration and to keep this information updated.

2.3 You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use of your account.

2.4 We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or are used for fraudulent or unlawful purposes.

3. Subscription Plans, Fees, and Billing

3.1 Access to the Service is provided under subscription plans (including Ecommerce Starter, POD Basic, POD Studio, and Enterprise plans) as described on our Pricing page. Features available to you depend on your selected plan.

3.2 Subscription fees are billed in advance on a recurring basis (monthly or annually, as selected at signup) and are non-refundable except as required by applicable law or expressly stated otherwise.

3.3 We may change subscription pricing with prior notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.

3.4 You are responsible for any applicable taxes, duties, or governmental charges associated with your use of the Service, except taxes based on our net income.

3.5 Failure to pay applicable fees may result in suspension or termination of your account and access to your storefront.

4. Merchant Responsibilities

4.1 You are solely responsible for the products you list, the accuracy of product descriptions and pricing, and compliance with all applicable consumer protection, advertising, and product safety laws in the jurisdictions where you sell.

4.2 You must have all necessary rights, licenses, and permissions for any artwork, designs, images, text, trademarks, or other content ("Merchant Content") you upload to the Platform, including content submitted by your customers through the product customizer.

4.3 You are responsible for fulfilling your obligations to your own customers, including order accuracy, delivery timelines, refunds, and customer service, except to the extent fulfillment is directly handled by a print fulfillment partner integrated through the Platform.

4.4 You must not use the Service to sell counterfeit goods, infringe intellectual property rights, or list products that are illegal, fraudulent, or that violate applicable law.

5. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable local, national, or international law;
• Upload or transmit content that is defamatory, obscene, infringing, or that violates the rights of any third party;
• Attempt to gain unauthorized access to the Platform, other Merchant accounts, or our systems and networks;
• Reverse-engineer, decompile, or attempt to extract the source code of the Platform, except where permitted by law;
• Use automated means (bots, scrapers) to access the Service without our prior written consent;
• Resell, sublicense, or provide third-party access to the Service without authorization.

6. Third-Party Integrations

6.1 The Platform integrates with third-party payment gateways, shipping carriers, and print fulfillment partners (each, a "Third-Party Provider"). Your use of any Third-Party Provider is subject to that provider's own terms and policies, which we encourage you to review.

6.2 We are not responsible for the acts, omissions, availability, or performance of any Third-Party Provider, including payment processing failures, shipping delays, or production errors originating from a fulfillment partner.

6.3 Print-ready file generation, mockups, and production specifications are generated automatically based on the information and files you or your customers provide. You are responsible for reviewing outputs where the Platform provides a preview or approval step before an order proceeds to production.

7. Intellectual Property

7.1 The Platform, including its software, design, trademarks, logos, and underlying technology, is owned by LP Cloud Lab and its licensors and is protected by intellectual property laws. These Terms do not grant you any ownership rights in the Platform.

7.2 You retain ownership of your Merchant Content. By uploading Merchant Content, you grant us a limited, non-exclusive, worldwide license to host, display, reproduce, and process that content solely as necessary to operate and provide the Service to you (for example, generating product mockups or print-ready files).

7.3 Any feedback, suggestions, or ideas you provide about the Service may be used by us without obligation or compensation to you.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect personal data, including your customers' data processed through your storefront. By using the Service, you acknowledge and agree to the practices described in the Privacy Policy.

9. Service Availability and Modifications

9.1 We aim to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. Scheduled maintenance, updates, or unforeseen technical issues may result in temporary unavailability.

9.2 We may modify, add to, or discontinue features of the Service at our discretion, with reasonable notice where a change materially affects your use of a paid plan.

10. Suspension and Termination

10.1 You may cancel your subscription at any time through your account settings or by contacting support; cancellation takes effect at the end of the current billing cycle unless otherwise stated.

10.2 We may suspend or terminate your account, with or without notice, if you breach these Terms, engage in fraudulent or illegal activity, or where required to comply with law.

10.3 Upon termination, your right to access the Service ceases. We may retain or delete your data in accordance with our Privacy Policy and applicable data retention obligations.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT PRINT-READY FILES OR AUTOMATED PROCESSES WILL BE FREE OF DEFECTS IN EVERY CASE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LP CLOUD LAB, PODSTOREFRONT, AND THEIR OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless PODStoreFront, LP Cloud Lab, and their officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your Merchant Content, your violation of these Terms, or your violation of any applicable law or third-party right.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Jodhpur, Rajasthan, India, unless otherwise required by applicable local law for merchants in other jurisdictions.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified through the Platform or by email prior to taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
